By creating, participating in, or interacting with a raffle on XElementia Raffles (the “Platform”), operated by the XElementia team, you agree to these Terms & Conditions (“Terms”).

1) Definitions

  • Raffle: an NFT raffle created through the Platform on Solana, with tickets paid in $BASC.
  • Creator: the user who lists an NFT in a raffle.
  • Participant: a user who buys raffle tickets.
  • NFT: the digital asset offered as the raffle prize.
  • Escrow wallet: a Solana wallet controlled by the XElementia team that holds the raffled NFT and the ticket $BASC until settlement. Its address is shown on every raffle page.
  • BASC Pool: total $BASC collected from the ticket sales of a raffle.
  • Pending Escrow: raffle created but not live until the NFT transfer to the escrow wallet is confirmed on-chain.
  • Live: raffle open for ticket purchases after the escrow transfer is confirmed.

2) Eligibility & Compliance

  • You represent that you are legally permitted to use this Platform in your jurisdiction.
  • You are solely responsible for compliance with applicable gambling, lottery, tax, consumer, and digital-asset laws.
  • Creating raffles and buying tickets requires signing in with Discord and using your own Solana wallet. You are responsible for your wallet, private keys, and transaction approvals.
  • Raffle creation access: by default, creating a raffle requires having spent at least 420 $BASC in raffles. This prevents low-engagement accounts from creating new campaigns. The XElementia team may waive this requirement for team members, active tribe staff, superadmins, and partner communities.
  • Only NFTs from collections approved by the Platform can be listed. NFTs locked in staking cannot be listed.

The Platform does not provide legal, tax, or financial advice.

3) Nature of the Service & Custody

  • The Platform provides the interface and the operational tooling to run NFT raffles on Solana.
  • Custody: while a raffle runs, the NFT and the BASC Pool are held in the escrow wallet controlled by the XElementia team. Raffles are not run by an on-chain program or smart contract; you rely on the team to operate the escrow wallet as described in these Terms. Every transfer into and out of the escrow wallet is public on Solana and linked from the raffle page.
  • The Platform is not a bank, broker, exchange, or financial advisor.
  • Transactions are blockchain operations and are generally irreversible once confirmed.

4) Lifecycle, Finality & Execution

  • A raffle stays in Pending Escrow until the NFT transfer to the escrow wallet is confirmed on-chain. Only then does it become Live.
  • Once Live, a raffle cannot be canceled or paused by the Creator. The only change allowed is a one-time Xtra Time extension on Standard raffles (section 6).
  • Standard raffles have a fixed number of tickets (69) and an end time chosen at creation (5 to 45 days). Each Discord account and each wallet can hold up to 5 tickets per raffle.
  • Flash raffles have 30 tickets and last 24 hours from the moment the NFT is in escrow. Each Discord account and each wallet can hold up to 3 tickets. Only the XElementia team and its partners can create them, and they cannot be extended.
  • Sold out: a Standard raffle does not close instantly when it sells out. If more than 30 minutes remain, the end time moves to 30 minutes after the sell-out (reveal window); otherwise the original end time is kept. A Flash raffle closes 2 minutes after its last ticket is sold.
  • Winner selection: at close, every ticket becomes one slot, in purchase order. The Platform computes a SHA-256 hash of public raffle data (raffle ID, tickets sold, last update time, and end time), and that hash selects the winning slot. The seed hash, the slot list, and a replay are published on the raffle page so anyone can verify the result. The selection runs on the Platform’s servers, not in an on-chain program.
  • No tickets sold: if a raffle ends without any ticket sold, the NFT is returned to the Creator’s wallet. No payout or burn applies.
  • Settlement: the NFT is sent to the winner, 95% of the BASC Pool is paid to the Creator, and 5% is burned. All three transactions are published on the raffle page. Settlement is automated; if a step fails, the XElementia team completes the pending steps manually, keeping the same winner and amounts.

5) Economics & Fees

  • The Creator sets the ticket price in whole $BASC. The maximum price is capped against the NFT’s market reference (collection floor, most valuable trait, and rarity where available) and is shown during creation.
  • Creator payout: 95% of the BASC Pool.
  • Burn: 5% of the BASC Pool is permanently burned (SPL token burn).
  • A creation fee in SOL (depending on raffle duration), a SOL platform fee per ticket, and Solana network fees apply. Current amounts are always shown before you sign.
  • Confirmed ticket purchases are final and are not refunded, including when a raffle does not sell out.
  • If a confirmed payment cannot be applied because of a technical failure or a duplicate payment, the XElementia team reconciles it manually: it either applies the payment or refunds it to the sending wallet. Contact the team on Discord if this happens to you.
  • Unless required by law or stated in these Terms, paid fees are final and non-refundable.

6) Xtra Time

  • While a Standard raffle is Live, its Creator can extend the end time once, with a 5, 10, or 15 day plan paid in SOL. The fee is shown before signing. Flash raffles cannot be extended.
  • A second Xtra Time payment for the same raffle is not applied and is flagged for a manual refund.

7) Market Data

  • Floor prices, trait values, rarity, and NFT metadata come from third-party marketplaces and indexes. They are shown as reference signals only and are never guaranteed prices or valuations.

8) Technical & Operational Risks

  • Blockchain congestion, RPC failures, wallet/provider outages, indexing delays, and third-party service failures may affect timing and availability.
  • Because the escrow wallet is operated by the XElementia team, raffles also depend on the team’s operational security and continuity.
  • No guarantee is made regarding uninterrupted service, exact timing, raffle fill rate, profitability, or NFT market value.

9) Wallet & Signature Responsibility

  • You must verify destination addresses, amounts, and prompts before signing.
  • Loss of private keys, incorrect approvals, or compromised wallet environments are your responsibility.

10) Prohibited Conduct

  • Unlawful activity, fraud, manipulation, sanctions evasion, and abuse of Platform rules (for example, using several accounts or wallets to exceed ticket limits) are prohibited.
  • The Platform may restrict access or actions where required for security or compliance reasons.

11) Limitation of Liability

To the maximum extent permitted by law, the Platform is provided “as is” and “as available”, without express or implied warranties. The Platform is not liable for direct, indirect, incidental, or consequential losses related to blockchain transactions, wallets, or third-party infrastructure.

12) Updates & Re-Acceptance

  • These Terms may be updated with a new version and effective date.
  • Notice may be provided through the Platform and this legal page.
  • New versions may require explicit re-acceptance before creating new raffles.

13) Governing Law & Jurisdiction

These Terms are governed by the jurisdiction designated by the Platform’s legal entity or official legal documentation. Where mandatory consumer protections apply by law, those protections remain in force.

14) Acknowledgment

By using the Platform, you acknowledge that you understand blockchain, wallet, and custody risks, have reviewed these Terms, and accept responsibility for your actions.
